Terms of Sales

Article 1: Purpose

These general terms and conditions of sale govern the commercial relationship between PRO SHOP RXR and individuals and legal entities wishing to make a purchase from the rxrprotect.com website.
These general terms and conditions of sale are the only ones applicable and prevail over any other conditions not approved by PRO SHOP RXR.
PRO SHOP RXR reserves the right to modify these terms and conditions of sale at any time without notice. The applicable conditions are those in force at the date of the order.
Placing an order implies the buyer’s acceptance of these conditions.
You have the option of registering free of charge on a BLOCTEL (www.bloctel.gouv.fr) opposition list to telephone canvassing in order to no longer be canvassed by telephone by a professional with whom you have no current contractual relationship, in accordance with Law No. 2014-344 of March 17, 2014 relating to consumption.

Article 2: Products

The products sold are those presented in the catalog of the site rxrprotect.com.

Article 3: Product availability

Products are available for sale while stocks last. Quantities shown are for information only and do not represent a contractual commitment.
If a product is unavailable, PRO SHOP RXR will inform the customer as soon as possible by e-mail and propose an alternative solution.

Article 4: Prices

Prices do not include delivery and transport costs.
Product prices for European Community countries are shown in euros, all taxes included, on the date the order is validated by the customer.
Outside the Euro zone, prices are quoted in Dollars and are exempt from VAT. Customers must pay any customs duties or local taxes upon receipt of the parcel.
PRO SHOP RXR reserves the right to change prices or promotions at any time without notice.
PRO SHOP RXR does not guarantee prices appearing on other websites or price comparators.

Article 5: Ordering

There are two ways to place an order: by creating a customer account or by placing an instant order without creating an account.
The customer confirms his/her order by clicking on the “Confirm your order” link, after having accepted the present terms and conditions of sale.
PRO SHOP RXR confirms the order by e-mail; this information includes all the elements of the order.

Article 6: Payment

Payment is due with the order.
Payment is made by credit card and can be made through our secure payment partners: Paypal, Strip, Apple pay, Google pay, HiPay. Alma.
These two secure payment systems use the SSL (Secure Socket Layer) protocol, which encrypts the information transmitted so that no third party can gain knowledge of it during the payment process.
PRO SHOP RXR is not responsible for our payment partners, and cannot be held liable in the event of misuse or inaccessibility of these sites.
The customer’s account will be debited when the order is placed.

Payment in instalments with Alma.
If you pay for your order in instalments, you accept Alma’s general customer conditions. as well as Alma’s special conditions for RXR Protect customers.

Article 7: Delivery

PRO SHOP RXR is responsible for shipping costs within its delivery zone.
Deliveries are made to the delivery address given in the order process. The parcel is delivered against the recipient’s signature. In the event of absence, a notice of pending delivery is left in the addressee’s mailbox.
Orders are processed from Monday to Friday, subject to availability.
PRO SHOP RXR uses the following delivery methods: Colissimo, Dhl, Chronopost International.
Indicative delivery time: 2 to 4 working days for Europe, 5 to 9 working days for the rest of the world, depending on destination.
Deliveries outside France may be subject to taxes and customs duties, which are the responsibility of the customer upon arrival at destination.

Article 8: Withdrawal

Individuals or legal entities have a 14-day cooling-off period to return the product without justification or penalty.

RXR Protect undertakes to refund or replace the product within 14 days of the date of sale.
Return shipping costs are at the customer’s expense.
Deco kits and customizations are not refundable.
Shipping costs are non-refundable.

Article 9: Warranty

In compliance with the guarantee of conformity stipulated in articles L. 217-4 to L. 217-14 of the French Consumer Code and the legal guarantee against hidden defects stipulated in articles 1641 to 1649 of the French Civil Code, PRO SHOP RXR provides a guarantee within 2 years from the date of delivery. It will be possible to choose between repairing or replacing the good, subject to the cost conditions set out in article L.211-9 of the French Consumer Code.
The purchaser is exempted from proving the existence of a lack of conformity for a period of twenty-four months following delivery of the goods, except in the case of second-hand goods.
In the event of hidden defects in the item sold, the customer may choose between rescission of the sale or a reduction in the purchase price, in accordance with article 1644 of the French Civil Code.

Article 10: Customer service

Article 11: Liability

PRO SHOP RXR shall not be held liable in the event of non-performance of the contract entered into in the event of a product being out of stock or unavailable, in the event of force majeure or due to the product not complying with foreign legislation when delivered outside French territory.

Article 12: Retention of title

Until payment of the order, PRO SHOP RXR remains the owner of the product(s).

Article 13: Data protection

The information collected by PRO SHOP RXR is essential for order management.
In accordance with the French Data Protection Act of January 6, 1978, the buyer has the right to retract, oppose and delete this data on the rxrprotect.com website.

Article 14: Applicable law

This contract and the GTC governing it are governed by French law.

Article 15: Mediation

Contracts for the sale of Products concluded on the Site between any Buyer and PROSHOP RXR are subject to French law.
Nevertheless, in accordance with article 6.2 of the European “Rome 1” Regulation, the Buyer may, in any event, benefit from the application of mandatory consumer protection provisions applicable in his country of residence, which would be more favorable to him.
Dispute resolution and mediation
In the event of a complaint, the Buyer may contact Customer Service.
In the event of failure to file a complaint with Customer Service or in the absence of a response from this service, the Buyer may submit the dispute free of charge to the Association of European Mediators (AME CONSO), the mediator to which PROSHOP RXR adheres, which will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution.

The parties to the contract remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator. The Buyer may also submit any complaints to the dispute resolution platform set up by the European Commission at the following address: http://ec.europa.eu/consumers/odr/. The European Commission will transfer the Buyer’s complaint to the competent national mediators.
If the dispute persists, the Buyer may bring the matter before the competent courts.

CONSUMER MEDIATION SERVICE :
Amicable settlement of disputes between the professional and the consumer in accordance with articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the French Consumer Code.
In the event of an unresolved dispute between the Professional and the Consumer, the Consumer may refer the matter to the Consumer Mediator.
Before referring the matter to the Consumer Mediator, the consumer must already have attempted to resolve the dispute directly with the professional by means of a written complaint, or have made a complaint under the terms of the contract concluded with the professional.
Consumer mediation is an out-of-court settlement of consumer disputes. If the conditions are met, a consumer mediation procedure will be carried out according to a precise process and the texts in force.
The procedure is free of charge for the consumer (R612-1 of the French Consumer Code).

TO CONTACT THE CONSUMER OMBUDSMAN :
If no agreement is reached with the professional following a complaint.
Amicable settlement of disputes between the professional and the consumer in accordance with articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code (Conditions of admissibility). Procedure free of charge for the consumer.
The consumer mediator is neutral, independent and impartial. The mediator is not part of the company with which the consumer has a dispute.
